GENERAL TERMS AND SALES CONDITIONS (GTC)
 
These conditions apply to the sale of goods by Powr ´n Play through its online shop. These conditions are automatically available for consultation by customers on the page entitled ‘Customer Information’ of the power ´n play website. Consequentially, the customer, by placing an order, unreservedly accepts all these sales conditions.
 
ARTICLE 1 – PRICES
1.1 - Prices of products are given in Euros including all taxes but excluding the cost of packaging and delivery. All orders are payable in Euros, irrespective of where they are made.

1.2 -For countries outside the European Union: you are entitled to a tax refund on our products and transport fees. Your invoice will not include German VAT. You must ensure, however, that you pay all the necessary duties and taxes when the goods enter your destination country and that you have the right to import these goods into your country.

1.3 - Power ´n Play reserves the right to modify its prices at any moment, however, goods will be charged on the basis of the rates given at the time of the order subject to availability on that date.

1.4 - Goods remain the property of Power ´n Play until complete payment for them has been received.

ARTICLE 3 - PROCESSING OF ORDERS
You must read and accept these Sales Conditions before completing your order. The submission of your order, therefore, implies the acceptance of these Sales Conditions.
Unless proved otherwise, the information collected by the powernplay.com site constitutes proof of the whole of the transactions made by the powernplay.com site and its customers.
 
ARTICLE 4 – AVAILABILITY
The supply of our products and their prices are valid for as long as they are visible on the site, subject to availability. Goods are subject to availability of stock. Provision of goods not stocked in our shops is subject to availability with our suppliers.
If a product is no longer available after an order has been processed, we will inform you by email or by post as soon as possible. You order will be automatically cancelled and any monies debited from your bank account immediately refunded.
 
ARTICLE 5 – DELIVERY
5.1 - General conditions
Goods purchased on powernplay.com are delivered to the address you give during the ordering process. In the case of items having different delivery dates owing to their availability, the overall delivery date is set to accommodate the longest of these delays. Nevertheless, Power ´n Play reserves the right to split orders and make multiple deliveries. You will only be charged postage and packaging for a single delivery. Power ´n Play cannot be held responsible for the consequences of delays in transportation.
In the case of delay, you will be sent an advisory email. In this case and as long as the product has not been dispatched, you can still cancel your order.
5.2 - Delivery problems
You must notify the courier service and Power ´n Play of any problems or complaints concerning the product(s) delivered (eg. damage to packaging, packaging already opened, etc) within three days of receipt of goods.
5.3 - You may claim under the following conditions of exchange and reimbursement, where they are applicable to the examples detailed within the following article.
5.4 - Product conformity
We undertake to refund or exchange those goods that are defective or do not correspond to those on your order. If this is the case, we ask that you send us a detailed written explanation of the error/damage and return the products(s) to us. Power ´n Play will, according to your choice, exchange the product(s) or refund the cost. All requests for exchange or reimbursement must be made within seven working days of receipt of goods. Any request made after this period cannot be accepted. Goods must be returned to us, together with all elements delivered (accessories, packaging, instructions for use etc), in the same condition as you received them.
 
ARTICLE 6 – PAYMENT
Payment for goods must be in advance made by:
- Bank transfer (or ask for paypal)
 
ARTICLE 7 – REFUNDS
Refunds, in accordance with articles 5 and 8, will be made no later than fifteen days after we receive the products.
Power ´n Play retains the right to choose the form of reimbursement, by either crediting your bank account directly or making out a cheque to the name of the customer who made the order at the billing address given.
No cash-on-delivery dispatches of any sort will be accepted.
 
ARTICLE 8 - SATISFACTION GUARANTEED OR YOUR MONEY BACK
You have seven days from delivery date to return goods that are unsatisfactory. You will be expected to pay the costs of their delivery and return. Only the cost of the product(s) will be reimbursed. This right of return only applies to products returned complete (including any accessories, instructions for use etc) and in good condition, in their original packaging and accompanied by a copy of the sales receipt. Products returned incomplete, broken, damaged or soiled by the customer will not be accepted.
 
ARTICLE 9 - INTELLECTUAL PROPERTY
9.1 - All text, notes, illustrations and images on Power ´n Play.com are reproduced all rights reserved and are protected by copyright and other intellectual property rights the world over. As such and in accordance Intellectual Property Code, these items are only authorised for personal use subject to the various different and indeed more restrictive clauses of the intellectual property code. It is strictly forbidden to reproduce all or any part of the Power ´n Play website.
9.2 - Certain products, such as software, are subject to specific and personal usage rights concerning their copying, public broadcast and hire. You must respect the sales conditions for these products and Power ´n Play cannot be held responsible for the use that might be made of these products in this case.
 
ARTICLE 10 -LIMITATION OF LIABILITY
The service offered by Power ´n Play may direct the user towards other websites. Power ´n Play is in no way responsible for the information contained in these other sites.
Power ´n Play is not responsible for any harm or damage associated with the use of information, products and services advertised on its site. Power ´n Play cannot guarantee the accuracy of the information, text, images and other elements featured on the Power ´n Play website.
 
ARTICLE 10.1 –LIABILITY
The goods offered for sale conform to current German statute law and norms. Power ´n Play cannot be held responsible for the non-respect of laws governing the country of delivery (eg. prohibition of a product). It is your responsibility to check with the relevant local authorities concerning the importation and use of a product you wish to order.
Photos are for illustrative purposes only. You are requested to refer to individual product descriptions for precise specifications.
Power ´n Play is only responsible for the contents of the pages it publishes. Power ´n Play cannot be held responsible for conspicuous errors between a product’s specifications and its representation and/or sales conditions.
In the case of products bought for professional use, Power ´n Play.com is not liable for any consequential damage hereby incurred, operating loss, loss of profit, damages or fees arising from the purchase of these goods. Our products are compatible with professional use. Consequentially, Power ´n Play.com is not liable for any harm or damage resulting from professional use.
 
ARTICLE 11 –WARRANTY
For the product to be covered by the warranty it is essential that you retain your receipt as proof of purchase.
Contractual warranties do not cover the following:
- abnormal and incorrect use of goods. In this regard, we ask that you carefully consult the user guide provided with the product(s),
- defects and their associated consequences resulting from incorrect use of the product (professional, group use),
- defects and their associated consequences resulting from any external factors,
However, and in any event, you are covered by the clauses of the legal guarantee, notably those concerning  or latent defects.

ARTICLE 12 - GOVERNING LAW – DISPUTES
In accordance with the Computing and Rights law of 6 January 1978, you have the right to access, correct and block data about yourself. To exercise this right, contact us online or by post stating your first name, family name and address.

ARTICLE 13 - PLACE OF FULFILMENT, VENUE, APPLICABLE LAW, CONTRACT, LANGUAGE
13.1. - Place of fulfilment is Stuttgart/Germany.
13.2. - Venue for all disputes arising from this contract is Stuttgart if the Buyer is a full merchant, a legal person under public law, or a special fund under public law. We are also entitled to take court action at the place where the Buyer’s head office is located.
13.3. - German law applies exclusively, particularly with regard to foreign business, with the exclusion of the common UN law on the sale of goods (CISG). The contract language is German.
 
ARTICLE 14 – LEGAL  VALIDITY OF CONTRACT
In the event that individual points are legally invalid, the contract remains valid in its remaining parts.

 

WARNING
For climbing and mountaineering only. Climbing is dangerous. Understand and accept the risks involved before participating. You are responsible for your own actions and decisions. Before using this product, read and understand all instructions and warnings that accompany it and familiarize yourself with its capabilities and limitations. We recommend that every climber seek qualified instruction. Failure to respect any of these warnings can result in severe injury or death!
 
Belay Devices
Although belaying is relatively simple, it requires complete attention and commitment. The belayer is responsible for catching the climber’s fall and there is no margin for error. Whether you are belaying or rappelling, control of the rope is regulated by your brake hand. Your brake hand must never leave the rope at any time.
